Photobooth Terms of Service

TL;DR

By using the Growl Photobooth you agree to the following:

• Photos taken of you will be publicly accessible for download on Growl’s website.
• We may use your photos to promote Growl and other Growl-affiliated events.
• You may use photos you’re in for whatever you want, including commercial purposes (excluding AI) as long as you credit our photographer @BoltLatex.

The Fine Print

1. Agreement to Terms

1. These Terms of Use constitute an agreement made between you (“you”), TigerFox Productions, LLC (“Growl”, “we”, “us”, or “our”), and @BoltLatex (“@BoltLatex” or “photographer”) concerning your access to and use of our photobooth (“Photobooth”) at our events.
2. By entering and using the Photobooth you agree that you have read and understood this agreement, as well as the Growl Code of Conduct, and that you agree to be bound by both.

2. Accessing Photographs

1. By using the Photobooth, you acknowledge and agree that photos taken of you will be made publicly accessible for download on our website and/or other online platforms.
2. Instructions for accessing and downloading the photos will be provided on our website and social media sometime after the event.

3. Your Permissions for Photo Use

1. You are granted permission to use the photos in a similar manner to the Creative Commons Attribution 4.0 International License:
   1. As such, you may share and adapt the photos freely (commercial purposes included), provided that you give appropriate credit to the photographer, @BoltLatex.
   2. You may not apply legal terms or technological measures that restrict others from doing anything our license permits.
   3. You are explicitly prohibited from using the photos in any AI-related applications. Including but not limited to training AI models, generating synthetic media, or any other form of automated processing.
2. Please note that this license is granted only for the photos in which you appear.
3. Photos made available for download will feature a Growl watermark. While you may crop-out or digitally remove it when adapting and/or sharing, we will not be providing un-watermarked versions upon request.
4. The photographer and Growl retain the copyrights to all photos taken at the Photobooth. Your use of the photos under the license does not grant you ownership of the original images or their copyrights.

4. Use of Photos for Promotion

1. You grant us the right to use photos taken of you to promote our events. This includes, but is not limited to, posting on our website and social media platforms. While we will make every effort to tag you in any social media posts, we cannot guarantee that we will be able to do so in every instance.

5. Photo Removal Requests

1. If you wish to have any photos you appear in removed from our website, social media, or promotional materials, please contact us at tigerfoxproductions@gmail.com.

6. Termination & Refusal of Service

1. Growl and its photographer reserve the right to refuse service and turn away individuals for any reason, including but not limited to violations of the Growl Code of Conduct or inappropriate behavior.
2. Growl reserves the right to withhold photos taken at the Photobooth for any reason, including but not limited to any violation of this agreement.

7. Limitation of Liability

1. Growl and it’s photographer are not liable for any damages or claims arising from the use of the photos taken at the Photobooth, including but not limited to claims related to privacy, publicity, or copyright infringement.

8. Changes to Terms

1. We reserve the right to modify these Terms of Use at any time. Your continued use of the Photobooth after any changes constitutes your acceptance of the new terms.

By using the Photobooth, you confirm that you have read, understood, and agree to these Terms of Use. If you do not agree to these terms, please refrain from using the Photobooth.
